Mother’s quest for justice

Patsy Naidoo, the mother of the late Kavlin Naidoo, who was shot in a road rage accident in 2014, continues to seek justice for her son as the trial of his alleged killer approaches next month.

The heart-broken mother has since engaged the services of a private attorney and is seeking to have his trial heard at the Pietermaritzburg High Court rather than the Regional Court – as the culpability and conviction in the High Court packs a greater punch there.

Patsy’s attorney Siva Chetty said with the proper forensic testimony, he would be able to approach the Director of Public Prosecutions to consider prosecution in the High Court rather than the Regional Court.

“Unfortunately, Mrs Naidoo, not being gainfully employed and being supported solely by her (late) son is placed in a rather invidious position and accordingly seeks assistance in that regard,” said Chetty.

He said the plea was to secure funding to permit them to instruct experts and to “do all that should be done if she was indeed possessed of funds” to obtain justice.

Chetty said he intended instructing independent pathologist Dr Reggie Perumal and forensic expert Kobus Steyl, to give evidence on the crime scene, bullets found in the deceased, and bullet trajectory, among other issues, but was prevented from doing so due to a lack of funds from Patsy.

Funds received will then be transferred to Chetty’s Trust account.

“I am willing to forward details and disclose how the funds are utilised and what disbursements are made once the monies are deposited into my trust account from the special account set up to raise funds,” said Chetty.

Twenty seven year old IT engineer, Kavlin Naidoo, was shot in the stomach on November 2, 2014 after a man driving a red Toyota Auris allegedly cut in front of him, blocking his way. Naidoo, who had been with his fiancée and brother, was shot in the stomach when he alighted his vehicle to investigate. Naidoo died 20 days later at the Grey’s Hospital.

The accused, Sergeant Thobalani Khuzwayo, previously based at the Pietermaritzburg police station, is out on R2000 bail.
